GiftMinder LLC (“GiftMinder,” “we,” “us,” or “our”) operates the website at https://minder.gift and related services (the “Service”). This Privacy Policy explains how we collect, use, disclose, and protect your personal information.

“Personal Data” is information that identifies, relates to, or describes directly or indirectly, you as an individual such as your name, email address, phone number, address, and/or payment information. The types and categories of personal data we collect or process may include:
- Account Information: Email address, display name, and authentication credentials
- Profile Information: Name, profile photo, birthday, address, and interests
- Contact Information: Names, relationships, birthdays, and other details about people in your contact list
- Demographic Information: Including age, gender, education or family or marital status (if you have consented to provide such information)
- Gift Information: Gift ideas, descriptions, product URLs, prices, notes, images, and purchase status
- Wishlist Information: Wishlist names, items, and sharing preferences
- Event Information: Event names, dates, and associated contact information of giftee or invitee (name, phone number, address, etc., as needed, incorporated or imported by user)
- Communications: Messages or information you send to us directly
- Device Information: Your IP address, language preferences, browser type and settings, and other device information
- Location Data: You can choose whether or not to allow the Services to collect and use real-time information about your device's location. If you block the use of location information, some services may become inaccessible or not function properly.
We collect information when you interact with our Services, such as when you create an account, update, place an order, purchase, reserve, bookmark, participate in surveys, promotions, etc.
Information Collected Automatically
As you navigate through our Services, we may use automatic data collection technologies to collect information that may include personal data. Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies, web beacons, and other tracking technologies including your interactions with or through our Services. Using automatic collection helps us improve our Services to deliver a better and more personalized experience.
- Log Data: IP address, browser type, operating system, referring pages, date/time of access, and pages viewed
- Device Information: Device type, screen resolution, and general device identifiers
- Communications: Including email, text, chat, and other electronic messages through the use of our Services
- Statistics or Aggregated Information: Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific Services feature.

- Technical Information: Includes information about your internet connection and usage details about your interactions with the services such as clickstream information, to, through, and from our Services (including date and time), products that you view and search for, length of visiting times, page interaction information, and browsing to or away from products or pages.

Cookies
We use essential authentication cookies managed by Supabase to keep you logged in. We do not currently use third-party advertising cookies or tracking pixels.

Some parts of the Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those parts or opened an email and for other related statistics.

We implement commercially reasonable technical and organizational measures; however, no method of data transmission or storage is 100% secure, and we do not warrant absolute security.

- Send transactional emails (welcome, reminders, connection requests)
- Send marketing emails such as our monthly newsletter (you may opt out) to promote our Services
- Process and track affiliate link clicks
- Improve and develop the Service including analyzing information and creating aggregated data to develop, maintain, analyze, improve, optimize, measure, and report on our Services and their features and how users interact with them
- Protect the Service and our users including enforcing our rights arising from contracts entered into and between you and us

With Other Users
When you use social features (shared wishlists, user connections), certain information may be visible to other users based on your sharing settings.
With Service Providers
When you interact with these Services, there are third parties that may use automatic collection technologies to collect information about you or your device. These third parties may include: advertisers, analytics companies, your device manufacturers, your internet or mobile service provider. We do not control these third parties' tracking technologies nor how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible service provider directly.
We may receive personal data about you from other sources or service providers below and combine that with the information we collect from you. For example, we may obtain information about you from the service providers below to engage to perform services on your behalf such as, but not limited to, content delivery, promotion services, analytics, payment processing, personal preferences, and demographic information so that we can provide you with personalized experience.

For Legal Reasons
We may disclose your information if required by law, to protect our rights, prevent wrongdoing, or protect user safety. If we believe disclosure is necessary or appropriate to protect the rights, safety, and property of our organization, our customers/members, or others. Where required by law or upon request for certain uses including, but not limited to, complying with any court order, legal process, or response to government or regulatory requests.
Business Transfers
If GiftMinder LLC is involved in a merger, acquisition, or sale of assets, your information may be transferred. We will notify you before your information becomes subject to a different privacy policy.
4. Data Retention
We keep categories of personal data described in this policy for as long as reasonably necessary to fulfill the purposes described or as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with legal obligations, resolving disputes, and/or for safety, security, and fraud prevention. This means we consider our legal and business obligations, potential risks of harm, and the nature of the information when deciding how long to retain personal data. At the end of the retention period, personal data will be deleted, destroyed, or de-identified.
- Account and user data: Retained until you delete your account
- Log and usage data: Up to 24 months
- Affiliate click data: Up to 24 months
- Backup data: Up to 90 days after deletion
When you delete your account, we will delete your personal information within 30 days, except where required by law.
5. Your Rights and Choices
Depending on your state of residency, you may have certain rights related to your personal data including:
- Access and Export: You may confirm whether we possess your personal data and access a copy of the personal data we possess. To the extent feasible, and as required by state law, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information, and it will be included in the response to your request.
- Deletion: You may request that we delete personal data about you that we maintain subject to certain exceptions under applicable law.
- Correction: You may request we correct inaccuracies in your personal data that we maintain taking into account the information's nature and processing purpose.
- Marketing Opt-Out: Unsubscribe from marketing emails via the link in each email or your account settings
- “Do Not Share”: You may request that we do not use your personal data for these purposes
Requests for access, deletion, correction or “do not share” preferences should be emailed to hello@minder.gift. We will honor your request within 10 business days.
6. Security
We implement commercially reasonable technical and organizational measures designed to protect your personal data from accidental loss or destruction from unauthorized access, use, alteration or disclosure. We use encryption in transit (TLS/SSL), encryption at rest, secure authentication methods, and row-level security in our database. However, no method of transmission or storage is 100% secure, and we do not warrant absolute security of your personal data transmitted through, using or in connection with the services. You should carefully decide what information you send us via such communication channels. Any transmitting of personal data is at your own risk.
The safety and security of your information depends on you. You are responsible for taking steps to protect your personal data from unauthorized use, disclosure, or access.
7. Children's Privacy
The Service is not intended for anyone under 18 and we do not knowingly collect any personal data from anyone under 18. If we learn that we have collected the data of a person under 18 without parental verification or consent, we will delete that information immediately. 8. California Residents — CCPA Rights
If you are a California resident, visit https://oag.ca.gov/privacy/ccpa for more information about the retention periods that apply to the personal data categories we collect. California residents have the right to:

- Delete your personal information
- Opt out of sale — we do not sell personal information
- Non-discrimination for exercising your rights

9. International Users
The Service is operated from the United States. By using the Service, you consent to the transfer of your information to the United States. If you are in the EEA, UK, or other regions with enhanced data protection rights, contact us at hello@minder.gift to exercise your rights.
10. Changes to This Policy
We may update this Privacy Policy from time to time. For material changes, we will notify you by email or prominent notice. The date your privacy policy was last updated is identified at the top of the page. We may email or otherwise communicate reminders about this policy, but you should continue to check our Services periodically to see the current policy and any changes we have made to it. Your continued use after changes take effect constitutes acceptance of the terms of this Policy and our Services.
